These Terms and Conditions (“Terms”) govern your access to and use of the services provided by GradeGenie (“Company”, “we”, “our”, or “us”). By using or subscribing to our services, you agree to be bound by these Terms.
GradeGenie provides AI-powered academic tools and automation features via a paid subscription. Services are licensed, not sold, and intended for lawful educational or administrative use only. We may update, enhance, or discontinue features at our discretion without prior notice.
2.1 Recurring Billing
By subscribing, you authorize GradeGenie to charge your payment method on a recurring basis (monthly or annually) until canceled.
2.2 No Refunds
All payments are final and non-refundable, including unused time, failed cancellations, or partial use.
2.3 Price Changes
We may revise pricing with at least 30 days’ notice. Continued use after the effective date implies acceptance.
2.4 Failed Payments
If your payment fails, your access may be suspended or terminated without notice.
You agree not to:
Share login credentials or allow unauthorized access
Reverse-engineer, copy, or replicate GradeGenie’s platform, models, or tools
Use the service to deceive, harm, or exploit others
Overload, probe, or attempt to disrupt our systems
Violations may lead to account suspension and be reported to relevant authorities.
We may suspend or terminate your access, with or without notice, if:
You violate these Terms
Misuse or abuse is detected
Required by law or regulation
Decisions are at our sole discretion. No refunds will be issued upon termination.
All content, code, models, tools, and documentation are owned by GradeGenie. You may not copy, modify, distribute, or repurpose any materials without our written consent.
Your data is processed according to our Privacy Policy. By using the service, you consent to data use for delivery, analytics, product improvement, and security.
You retain ownership of your submitted content but grant us rights to process it for grading, training, and product enhancement purposes.
The service is provided “as is” and “as available” without warranties of any kind.
We do not guarantee:
Continuous availability
100% accuracy of AI outputs
Suitability for any specific educational outcome
You are responsible for reviewing and verifying AI-generated content before use.
GradeGenie is not liable for:
Indirect, incidental, or consequential damages
Loss of data, income, or educational outcomes
Errors or omissions in AI-generated results
Total liability is capped at the amount you paid in the 3 months before the issue arose.
These Terms are governed by the laws of the Hong Kong Special Administrative Region.
Any disputes arising from these Terms shall be resolved by confidential arbitration in Hong Kong, in English, under the rules of the Hong Kong International Arbitration Centre.
You agree that GradeGenie’s officers, directors, employees, and agents shall have no personal liability related to your use of the service.
You agree to indemnify and hold GradeGenie and its directors, officers, employees, and agents harmless from any claims, liabilities, or expenses arising from your breach of these Terms or misuse of the service.
Sections 5 (Intellectual Property), 7 (Disclaimers), and 8 (Limitation of Liability) shall survive termination or expiration of your account or use of the service.
We may revise these Terms at any time. If changes are material, we’ll notify you via email or in-app. Continued use of the service after updates constitutes acceptance.
